The administrator of your personal data is PRZEDSIĘBIORSTWO SZWEDZKO - POLSKIE "ALUCOLOR" sp. z o. o., Grunwaldzka street 6, 84-230 Rumia, NIP: 5830007778 (hereinafter: "ALUCOLOR").

General provisions

We pay special attention to protect personal data of users (hereinafter: the user, the users, you, your) that visit our domain, *.alucolor.pl (hereinafter: the service, the website). We make sure that the processing of your personal data is in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR), the Act on the Protection of Personal Data and Special Provisions. The privacy policy is available to all interested parties. The website is available to everyone. Any person using the website in any way accepts all the regulations contained in this Privacy Policy.

How do we use your personal data?

ALUCOLOR may collect your personal data and data of a different nature, which takes place, depending on the nature of the data - automatically or as a result of actions of persons visiting the website.

The personal data of the user can be processed by ALUCOLOR:

  • if the user agrees to this by completing the form available on the website, in order to take action specified on these forms (Article 6(1)(a) of the GDPR); or
  • when the processing is required for the performance of the contract to which the user of the website is a party of (Article 6(1)(b) of the GDPR), in cases, when the website enables the user to conclude an agreement between the Administrator and the user.

All the personal data processed as part of the service is voluntarily provided by the user. ALUCOLOR processes personal data of the users only to the extent necessary for the purposes specified above and for a period necessary to achieve these objectives, or until the user's consent is revoked. Not providing the required personal data by the user can result, in some situation, in the inability to achieve the objectives for which the personal data is necessary. 

The following personal data of the user may be collected as part of the forms located on the website or for the purpose of executing the agreements possible to be concluded within the service: name, surname, address, e-mail address, telephone number, login, password.

The personal data contained in the forms, provided by the user to ALUCOLOR, may be transferred to third parties cooperating with ALUCOLOR in order to complete of the purposes set out above.

The personal data provided in the forms available on the website are processed for the purposes resulting from the purpose of a specific form. In addition, the personal data may be used by ALUCOLOR for archival and statistical purposes. The consent of the user is expressed by appropriate selection in the form. 

The user, if the website has such functionalities, may refuse or give permission to receive commercial information by means of electronic communication (in accordance with the Act of 18 July 2002 on Electronically Supplied Services, as amended) by appropriate selection in the registration form. 

If the user agreed to receive commercial information by means of electronic communication, he has the right to withdraw such consent at any time by sending an e-mail to ALUCOLOR (alucolor@alucolor.pl) with an appropriate request and the name and username of the user. 

The personal data provided in the forms may be transferred to IT services performing certain services – in particular, it concerns the transfer of information about the holder of the registered domain to the domain operators or other entities that ALUCOLOR cooperates with.   

The personal data of the users are stored in a database which provides technical and organizational measures to assure that the protection of the processed data is compliant with the requirements set out in the relevant regulations.

To prevent re-registration of users whose participation in the service has been terminated due to an unauthorized use of the website, ALUCOLOR may refuse to delete the personal data required to block the possibility of re-registration. The legal basis for the refusal is art. 19(2)(3) in connection with art. 21(1) of the Act of 18 July 2002 on Electronically Supplied Services, as amended. The refusal to delete the personal data of the users by ALUCOLOR may also take place in other cases provided by the law.

In the cases provided for by law, ALUCOLOR may share some of the personal data of the users with third parties for purposes related to the protection of third party rights.

ALUCOLOR reserves the right to send e-mails to all the users with notifications of important changes to the site and changes in this Privacy Policy. ALUCOLOR may send commercial messages, such as advertising messages and containing other commercial information, in the form of e-mails, provided that the user has given his consent. Advertisements and other commercial information content may also be attached to incoming and outgoing e-mails from the system account.

Under what terms and on what basis do we process your personal data?

We ensure that your personal data is:

  • processed in a fair and transparent manner and in accordance with the law;
  • collected for specific and legitimate purposes;
  • adequate, relevant and limited to what is necessary;
  • correct and updated as necessary;
  • kept for no longer than necessary;
  • processed in a manner ensuring adequate security.

For how long do we process your personal data?

The time that ALUCOLOR may process your personal data depends on the legal basis that constitutes a legal condition for the processing of the personal data by ALUCOLOR.

We process personal data for the period necessary for the execution of the contract concluded with the user, and after that, for the period and within the scope required by the law and the period after which the claims, resulting from the contract, expire.

If we process personal data on the basis of a justifiable interest, in particular, for the purpose of direct marketing, we store the personal data until the user files an objection to such processing. After the objection, the further storage can be performed only to ensure completion of the contract or in cases required by the law. 

What rights do you have?

Each and every user has the following rights:

  1. The right of access to data
    The user is entitled to obtain confirmation from ALUCOLOR, whether his personal data is processed, and if it is, the user is entitled to access that personal data. ALUCOLOR will provide the user a copy of the personal data that is being processed.
  2. The right to correct data
    The user has the right to request that ALUCOLOR corrects personal data which is incorrect.
  3. The right to delete data ("the right to be forgotten")
    The user has the right to request that ALUCOLOR deletes his personal data without delay, and ALUCOLOR is obliged to delete the personal data without undue delay, if one of the following circumstances applies:
    • personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
    • the user has withdrawn the consent on which the processing is based on;
    • the user has submitted an objection under Article 21(1) to the processing and there are no overriding legitimate grounds for the processing.
  4. The right to limit data processing
    The user has the right to request that ALUCOLOR limited the processing of personal data in the following cases: 
    • When the data is incorrect – until the data is corrected; 
    • The user has submitted an objection to the processing - until it is established whether the legitimate grounds for ALUCOLOR override the grounds for objection of the data processing;
    • Processing is against the law and the user opposes the removal of personal data, requesting a limitation of the data. 
  5. The right to transfer data
    The user has the right to receive, in a structured, common used machine-readable format, personal data about him provided to ALUCOLOR and has the right to send this personal data to another administrator without any limitation from ALUCOLOR. 

    The user has the right to request that personal data are sent directly by ALUCOLOR to another administrator, if is it technically possible. The right to transfer data cannot adversely affect the rights and freedoms of others.
  6. The right to submit an objection 
    If personal data are processed for the purposes of direct marketing, the user has the right, at any time, to submit an objection to the processing of his personal data for the purpose of such marketing, including profiling, to the extent that the processing is related to such direct marketing. The above rights of the users may be provided for a fee, in cases where the relevant law provides for such payment. In the event of a violation of the above rights or the user comes to a that his personal data are processed by ALUCOLOR in violation of applicable law, the user has the right to lodge a complaint with the supervisory authority.

Cookies

Cookie files (so-called "cookies") are IT data, in particular text files, which are stored in the user's end device and are intended to be used by the website. Cookies usually contain the name of the website from which they originate, the time of storage on the end device and a unique number.

As part of the activities performed by the Administrator, the cookies are used observe, analyze the traffic on the website and undertake remarketing activities. However, as part of above activities, the Administrator does not process any personal data within the meaning of the GDPR.

The website obtains the information about users and their behavior in the following way:

  • the website automatically collects information that is contained in cookie files;
  • through the data, in the forms available on the website, entered voluntarily by users;
  • by automatically collecting web server logs by the hosting operator.

During the visit, the data about the user may be collected, including, among others, IP address, type of web browser, domain name, number of page views, type of operating system, visits, screen resolution, number of screen colors, addresses of the websites, from which the website was entered into, the time of using the website. The above data is neither personal data, nor it allows to identify the person using the website.

The website may contain links to other websites. ALUCOLOR is not responsible for the Privacy Policies of these websites. The website owner encourages the user to read the Privacy Policies of those linked websites. 

The entity that installs cookies on the user's end device with intent to access these files is ALUCOLOR.

Cookies are used to:

  • adjust the content of the website to the preferences of the user and optimizing the use of the website, in particular, by allowing the website to recognize the user’s device to properly display the website that is tailored to his individual needs;
  • create statistics that help to understand how users use the website, which allows the owner to improve the structure and content of the website;
  • maintain the user's service session (after logging in), which does not entail re-entering the login and password on each of the subpages of the website.

The website uses the following types of cookies:

  • “necessary” cookies - enabling the use of services available as part of the website, e.g. authentication cookies;
  • Cookies used to ensure security, e.g. used to detect fraud;
  • "performance" cookies - used to obtain information about the way users use the website;
  • "advertising" cookies – that enables to provide users with advertising content more tailored to their interests;
  • "functional" cookies – enabling "remembering" the settings selected by the user, and adjusting the website to the website user, e.g. in the scope of the selected language.

The website uses two basic types of cookies: session cookies and persistent cookies. Session cookies are temporary files stored in the end device until the user leaves the website, logs out or disables the software (web browser). Persistent cookies are stored in the user's end device for a period of time that is specified in the parameters of cookies or until they are deleted by the user.

In most cases, software used for browsing websites allows cookies to be stored in the user's end device by default. The users may change their cookie settings at any time. These settings can be changed in the options of the web browser (software), for example, in a way that will prevent the automatic handling of cookies or force the browser to inform the user about each time the cookies are placed on his device. Restrictions on the use of cookies may affect some of the functionalities available on the website.

Cookies placed in the user's end device may also be used by advertisers and partners cooperating with the website owner.

Server logs

According to the accepted practices of most online services, the website operator stores http queries directed to the server of the website operator (information about some of the behavior of the users is subject to logging in the server layer). The browsed resources are identified by URL addresses. The exact list of the information stored in the web server logs is:

  • public IP address of the computer from which the query came;
  • client station name - identification performed by the http protocol, if possible;
  • the name of the user provided in the authorization process (login);
  • time of arrival of the query;
  • http response code;
  • the number of bytes sent by the server;
  • URL address of the site previously visited by the user (link referrer) - if the entrance to the website took place through a link;
  • information about the user's web browser;
  • information about errors that occurred during the execution of the http transaction.

The above data is not associated with a specific user browsing the pages available on the website. To ensure the highest quality of the website, the website operator occasionally analyzes logs to determine which websites are visited most frequently, which web browsers are used, whether the page structure does not contain any errors, etc.

The logs collected by the website operator are stored for an indefinite period of time as a supporting material for the proper administration of the website. The information contained in the logs will not be disclosed to any entities other than the website operator or entities related to the operator personally, by capital or contractually. On the basis of the information contained in the logs, statistics may be generated to assist in the proper administration of the website. The summaries of the statistics do not contain features identifying users of the website.
